U.S. District Judge Melissa Dubose wrote in order that it would lift a previous injunction issued on April 8 now that the Rhode Island Cannabis Act no longer requires all retail license holders to be Rhode Island residents.

“The revised Cannabis Act removed language that the court found violated the Dormant Commerce Clause of the US Constitution,” she wrote.

But that outcome depends on the 1st U.S. Circuit Court of Appeals in Boston sending lawsuits over Rhode Island’s former residency requirement for recreational cannabis licenses back to DuBose’s courtroom in Providence.

Tim Rondeau, a spokesman for the Rhode Island Attorney General’s Office, said Thursday that state prosecutors have asked to suspend all appeals to allow the district court to issue a preliminary ruling.

Twenty recreational cannabis retail licenses were suspended after DuBose’s April 8 decision, leaving about 100 applicants in limbo — many of whom continued to pay rent for storefronts they still can’t open.
