Arkansas inflated marijuana potency lawsuit moves from civil to federal court

An Arkansas lawsuit alleging that three medical marijuana cultivators and a testing lab in the state colluded to overstate THC potency levels in products has been moved to federal court.

According to Law360, the lawsuit, originally filed in February in Pulaski County Circuit Court, contends a multimillion-dollar arrangement was set up among the conspirators to defraud patients.

Growers Bold Team, Osage Creek Cultivation and NSMC-OPCO as well as testing lab Steep Hill were all named in the civil lawsuit, which contends their products tested 25% higher than other labs.

The suit also accuses Steep Hill of inflating THC potency results to incentivize companies to hire them.

Questionable lab standards, enforcement and the practice of “lab shopping,” where cultivators seek higher potencies, have been problematic in several other states.

Oregon voters approve pro-labor change to state cannabis law

Voters in Oregon appear to have approved an organized labor-friendly change to state cannabis law that’s had mixed results in other states.

With more than 80% of ballots counted, 55.7% of state voters cast yes ballots on Measure 119, which will require cannabis operators in the state to submit a “labor peace agreement” to regulators before receiving or renewing business permit, Oregon Public Broadcasting reported.

The voter initiative’s main sponsor was the United Food and Commercial Workers (UFCW) Local 555, which spent more than $2.8 million on the campaign after a failed attempt to impose a labor peace agreement (LPA) requirement through the state Legislature.

Trial over Nebraska’s medical marijuana ballot initiative might be extended

An 11th-hour legal challenge to Nebraska’s medical marijuana ballot initiative could extend to Monday, the eve of Election Day.

Witness testimony in the civil trial in Lancaster County began Wednesday and resumed at 8 a.m. CT on Friday, according to the Nebraska Examiner.

The trial was scheduled for three days.

The lawsuit against the Nebraskans for Medical Marijuana campaign, filed by an anti-cannabis former state senator and supported by top Republican officials, aims to confirm whether nearly 50,000 of the 115,000 signatures submitted from registered voters that were certified by the secretary of state are valid.

The questions over the contested ballots pertain to both of the state’s medical marijuana ballot initiatives.
