Haven’t spoken to Daniel in a while so great to hear that he’s decided to launch a firm working with his colleague from Mcglinchey and back in the day Greenlight, Perry Salzhauer.

The firm is  working in the cannabis & psychedelics fields as well as other highly regulated substances.

We talk about the type of work he’ll be doing, how he wants to approach things.

Daniel has been a cannabis lawyer from the moment he left law school and is a true 21st century lawyer working in new and developing industries with uncertainities.

Stumbling around the latest legal publishing lists for my other  legal information website that I publish Practicesource.com I was very pleasantly surprised to learn that Edward Elgar  are to publish a standalone title on cannabis and intellectual property next month.

Well researched and written cannabis legal titles are as rare as hen’s teeth and this will be the first title that I’m aware of that has taken a detailed look at the topic.

A quick email to the publishers put me in touch with author – editors, Professor Enrico Bonadio and Dr. Natalie Corthésy who guide us through the why, what and wherefores of the book.

This episode makes especially pleasurable listening as the English language never sounds better than when given to us by an Italian and a Jamaican.

I hope to get them both back sooner rather than later to dig into a bit more detail about specific IP issues popping up around the planet

Enrico Bonadio is Professor of Law at City St George’s University of London.

He teaches, researches and advises in the field of intellectual property (IP) law.

His current research agenda focuses on the intersection between IP and technology and protection of non-conventional forms of creativity, amongst other topics. He published so far three monographs – (i) ‘TRIPS and genetic resources’ (Jovene 2008); ‘Copyright in the Street – An Oral History of Creative Processes in the Street Art and Graffiti Subcultures’ (Cambridge University Press 2023); (iii) ‘Food, Philosophy and Intellectual Property – 50 Case Studies’ (with Andrea Borghini) (Routledge 2024). Natalie Corthésy is a graduate of The UWI Faculty of Law Cave Hill. She obtained her LLM from University College London and read for her PhD at Queen Mary University of London. She teaches Intellectual Property Law, Advanced Copyright Law, Geographical Indications in the Global market, Employment Law, Industrial Relations Law and Tort Law. She is the Associate Dean of Outreach and Continuing Legal Education and Coordinator of the LLM in IP Law and the Cultural and Creative Industries which she was instrumental in conceptualizing and launching with the assistance of the World Intellectual Property Organisation (WIPO).

Dr Corthésy is also a published poet and I’ll be making sure I read her collection

Quite simply people in the US like a soda so it is somewhat of a no- brainer that cannabis and hemp beverages are going to sell like hot cakes.

I discuss with Zach who has over a decade of experience in the cannabis sector both in-house and in private practice about his chosen area of specialization.

We dig into what’s happening, what the challenges are and the inexorable rise of the cannabis beverage.

Soon hemp drinks will be as American as apple pie. .. I imagine you will probably soon be able to get a hemp drink in apple pie flavor!

Partner Saul Ewing

Drawing on his experience as a former general counsel for two companies, Zack Kobrin is a transactional and regulatory lawyer who understands that business clients want practical advice on how to complete deals and navigate complex statutory and regulatory regimes affecting their growth and daily operations. Zack is the former vice president and general counsel for Trulieve Cannabis Corp., where he led and managed the company’s in-house and outside legal team in a $2.1 billion acquisition that turned the company into one of the largest cannabis operators in the United States. He also previously worked as general counsel and chief compliance officer for Cansortium Holdings LLC, a multinational cannabis company focusing on medical uses.

While Zack is a trusted legal advisor to a variety of industries, his knowledge and experience is particularly deep in the cannabis industry. Businesses ranging from multi-national cannabis companies to start-ups and ancillary support companies look to Zack for advice on business formation and development, corporate organization and structuring, and complex contract negotiations. A sampling of his transactional experience includes overseeing the formation of more than 20 cannabis-related companies across multiple states and countries and assisting a U.S. cannabis operator with the preparation of their initial public offering on the Canadian Securities Exchange. On the regulatory and compliance side of his practice, Zack advises on issues such as crafting and seeking approvals for licensing applications and transfers and preparing and filing federal and state regulatory registrations. Cannabis doom scrolling through linked in last week i came across the following post by Atlanta Georgia Lawyer Tom Church.

The headline caught my eye because very little information about cannabis or hemp comes out of the state and rarely do lawyers from that part of the world pop their heads above the parapet.

I contacted Tom to talk about this particular case and fell into a wider discussion about cannabis and hemp enforcement in the state.

Put it this way, prior to my conversation with Tom my knowledge was sitting on empty battery about the state.

After half an hour with Tom on zoom i feel much more up to speed, not withstanding the fact that he’s an absolute pleasure to converse with and i look forward to more conversations in the future.

I know i’m not meant to advertise but if you have Georgia on your mind he is your man.

Tom became a trial lawyer to represent people, not big corporations or powerful government agencies. Since graduating from law school and becoming an attorney, Tom has been able to fight for individuals by getting successful results in high stakes criminal cases, serious personal injury lawsuits, and civil rights litigation across Georgia and the rest of the country.

Tom has been recognized by several organizations based on his successful advocacy. In 2020, just a few years after graduating law school, Tom was selected as one of the Top 40 Under 40 Criminal Defense Trial Lawyers in Georgia by the National Trial Lawyers. Membership in the Top 40 Under 40 is by invitation only and limited to the top 40 attorneys in the state based on their qualifications, leadership skills, and proven results as a trial lawyer. Since 2021, Tom has been identified by Best Lawyers as “One to Watch,” a recognition awarded to young attorneys by their peers. While most “Ones to Watch” recipients have been in practice for at least five years, Tom received this recognition in only his third year of practicing law. Since 2022, Tom has also been named a “Rising Star” by Super Lawyers, a national organization dedicated to recognizing attorneys for significant achievements in their practice areas.

In his criminal practice, Tom handles a variety of cases at the federal and state level, including drug trafficking and conspiracy charges, white collar crimes, immigration offenses, and sex crimes. Several of these cases have resulted in acquittals, dismissals, or favorable plea deals with the prosecution. In post-conviction proceedings, Tom has obtained successful outcomes in appeals, habeas corpus petitions, and sentencing hearings, including by helping his clients get “time served” sentences, probation, or that help them avoid immigration consequences like deportation.

As part of his criminal practice, Tom has filed several motions for “compassionate release” on behalf of inmates all across the country, including in California, Texas, Virginia, and several other states, and he has been able to get several inmates released from prison early based on their vulnerable medical condition or because they received excessively harsh sentences. During the COVID-19 pandemic, Tom was able to obtain the release of roughly a dozen inmates based on their risk of severe or fatal illness while incarcerated.

Tom also has significant experience and a successful track record in civil asset forfeiture cases, in which the government tries to keep seized property by alleging the property was somehow involved in a person or business’s criminal activities. Tom has defended dozens of people and businesses in civil asset forfeiture cases and has helped his clients recover over $1 million in seized property, including cash, vehicles, and even real estate. Many of these individuals and businesses were subjected to unlawful seizures and raids based on their sale of legal hemp products.
