Judge allows suit filed by Pennsylvania medical marijuana delivery drivers

A federal court in Pennsylvania will not dimiss a lawsuit filed by former FarmaceuticalRX delivery drivers over employment classification with the medical marijuana company.

U.S. District Judge William Stickman, in a 15-page memorandum, denied the MMJ producer and its affiliates’ motion for dismissing claims filed under the Fair Labor Standards Act and Pennsylvania Minimum Wage Act, according to Law360.

The drivers claim in the suit that FarmaceuticalRX, which has operations in Pennsylvania and Ohio, misclassified them as independent contractors and denied overtime wages and they should have been considered full-time workers.

The judge ruled the drivers showed sufficient evidence that:

FarmaceuticalRX and affiliates FRX Management Holdings and FRX Growth Partners were acting as one employer. The drivers solely transported FRX products using company vehicles. They worked exclusively for the company. They performed an integral part of the business.

Missouri cannabis regulators recall 23,000 marijuana products

Missouri cannabis regulators recalled more than 23,000 marijuana products from several brands on Tuesday, saying they were not properly tested by Fulton, Missouri-based lab ClearWater Science.

The Missouri Division of Cannabis Regulation (DCR) said it recalled the products because they were not “compliantly” tested, so the agency could not verify whether they meet state health and safety requirements.

The DCR said it hasn’t received any reports of adverse effects; people who believe they might be having an adverse reaction should seek medical attention.

Patients and consumers should stop using the recalled products and either dispose of them or return them to the dispensary where they were purchased.

Nebraska medical cannabis qualifies for ballot amid controversy

Initiatives to legalize medical marijuana in Nebraska and set up a regulated MMJ market qualified for the November ballot on Friday, just hours after complications threatening the effort appeared.

Nebraska Secretary of State Bob Evnen certified the efforts of Nebraskans for Medical Marijuana on Friday, the same day prosecutors announced charges against Michael Egbert, a Grand Island man involved in the petition, for allegedly falsifying signatures.

Nebraska is one of a dwindling handful of states without any regulated marijuana program.

Michigan sets record with $295.4 million in monthly marijuana sales

Michigan marijuana retailers sold $295,412,252 worth of medical and recreational cannabis in August, setting a new monthly record.

The previous record was set in March, when total sales hit $288,843,279, according to MJBizDaily’s analysis of the latest data released by the Michigan Cannabis Regulatory Agency (CRA).

Sales in August were up 2.7% over July, when retailers reported $287,743,072 in total sales.

Medical marijuana sales accounted for less than 1% of total regulated cannabis sales in August, according to MJBizDaily analysis.

August marked the third-consecutive month of increasing sales in the state.

Michigan retailers in August also broke a monthly record for selling 100,894 pounds of flower, Cannabis Business Times reported.
